Terms and conditions

This website (the “Site”) is the exclusive property of Sergio Capone SRL, via Borgo Stretto, 6 Pisa (I), Italy. Use of the Site constitutes implied acceptance of the terms and conditions set forth below.

Art. 1 Subjects – Supplier: the company Sergio Capone, Via Borgo Stretto, 6, 56125 Pisa, C.F. and P.I. 01164520502 (hereinafter referred to as Supplier).
Customer: the person identified by the data entered upon registration and acceptance of these general conditions (hereinafter referred to as Customer).

Art. 2 Object of Service – Through the e-commerce service, the Supplier provides the Customer with a virtual store from which it is possible to view and purchase products from the Supplier. The Customer may view the Supplier’s electronic catalog and offerings and make purchases from the Supplier under these terms and conditions.

Art. 3 Acceptance of the general conditions of sale – The customer may purchase only those products that are available from time to time on the Site at the time of access by the customer, according to the quantities indicated therein. To make a purchase, the customer, by accessing the Site, must first register and then formulate a special order, following the instructions and computer procedures therein.
When making a purchase, the customer must provide, obligatorily, a personal, valid and regularly active e-mail address. The general conditions of sale may be updated or changed at any time by www.sergiocapone.com, which will provide notice through the pages of the website. The Customer, by telematically sending the confirmation of his purchase order, unconditionally accepts and undertakes to observe, in his dealings with www.sergiocapone.com , the general conditions of sale, including the conditions of payment set out below, declaring that he has read and accepts all the information provided.

Article 4 Prices and Warranty – All sales prices of marketed products are displayed and indicated within the website www.sergiocapone.com , the same constitute an offer to the public in accordance with Art. 1336 c.c.. Unless otherwise stated in writing, all prices quoted are “VAT included” and expressed in Euros. Shipping costs are understood to be excluded from the price of the object and, indicated separately, are the responsibility of the Customer. The validity of the indicated prices is always and only the one indicated by the procedure at the very moment of placing the order with the Supplier.
Delivery of products is made anywhere in Italy. Abroad, delivery is made only to the countries indicated in the appropriate list within the Site, where the transport, shipping and insurance costs are also indicated, which the customer must take care to check before confirming his purchase. All of the above costs shall be fully borne by the customer, in addition to the selling price of the products. For delivery abroad, in countries where so provided, additional transportation, shipping and insurance costs as indicated from time to time are payable, always at the customer’s expense, in addition to the taxes and/or levies provided for by the regulations of the country(ies) of transit and/or destination as applicable from time to time.

Art. 5 Obligations of the Customer – It is strictly forbidden for the Customer to enter false, and/or invented, and/or fictitious data in the registration procedure necessary to activate towards him/her the process for the execution of this contract and its further communications; the personal data and e-mail must be exclusively his/her own real personal data and not of third persons, or fictitious.
It is expressly forbidden to enter data of third persons. The Supplier reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers.
The Customer indemnifies the Supplier from any liability arising from the issuance of erroneous tax documents due to errors related to the data provided by the customer, being himself solely responsible for their correct entry. If the customer fails to collect the goods, the shipping costs and any charges incurred will be borne by the customer, therefore deducted from the amount that will be refunded.

Art.6 Mode and time of delivery – sergiocapone.com will deliver the requested product to the customer, through couriers and / or forwarders of its choice. If the customer/recipient is absent at the time of delivery, a new delivery can be arranged. Upon receipt of the goods at their domicile, the Customer must verify the integrity of the package and the quantitative and qualitative correspondence with what is indicated in the accompanying document.
Except in cases of force majeure, delivery to the customer of the purchased product is made indicatively within 7 (seven) working days from the order or, in any case, within the deadline of 30 (thirty) days from the order.
No responsibility can be attributed to www.sergiocapone.com for delayed or non-delivery due to force majeure or fortuitous events.

Art.7 Right of withdrawal – Pursuant to Art. 64 of Legislative Decree no. 205/06 the customer may exercise the right of withdrawal and return the product received, in accordance with the terms and conditions set out below.
The customer will be entitled to a refund of the price, shipping costs and return costs, for the return of defective products or products delivered that do not correspond to the order placed by the customer or in case of damage to the same due to transportation or shipping errors by Sergio Capone srl. You can make a return for any reason within 10 days of delivery. You can request a return in two ways: via e-mail at [email protected] or by contacting us via Whatsapp at +39 3468497240. Once a return is requested, it is necessary that the item be placed back in the same packaging and complete with all materials attached. We will email the waybill for the customer to print and attach to the package. It will always be our concern to fix the collection by the courier. The refund will be made after receipt of the shipment with the returned products. If the return does not meet the conditions listed, the refund will not be made. Once the condition of the goods has been ascertained, the refund will be made within thirty (30) working days through the same method of payment used by the customer to purchase: from the value of the purchase returned will be deducted any customs charges of the return to Italy. It should be noted that the integrity of the product to be returned is an essential condition for the exercise of the right of withdrawal and that Sergio Capone srl will comply with the necessary controls at the time of return. The product must be returned together with its original packaging, related documentation, and any additional components, without exception.

Article 8 Validity of Communications – The Supplier shall not be responsible for any fraudulent and illegal use that may be made by third parties of credit cards or other means of payment, when paying for products purchased. The Provider at no time during the purchase procedure is able to know the Customer’s credit card information, which will transmit it directly to the payment service provider without intermediation and to which it will be connected automatically, re-entering the Provider’s site at the end of the procedure.
For all online services on the site are applied the connection costs charged by the Provider used by the Customer for the same connection to which the Customer must contact to obtain the necessary information.

Art. 9 Jurisdiction and Jurisdiction – These general conditions of sale are governed by the laws of the Italian Republic. For any dispute the Italian Judicial Authority shall have jurisdiction.
Except for what may be provided for by mandatory provisions of law, the Court of Pisa shall have exclusive jurisdiction.

Art. 10 Intellectual Property – All elements of the Site whether or not subject to registration of an intellectual property right (photos, product sheets, descriptions, layouts) are the exclusive property of Sergio Capone SRL and may not be used. All designs, models, trademarks, text, visual or aural, commentary, artwork, illustrations, images, reproduced on www.sergiocapone.com are protected by copyright, trademark and image rights, and any other applicable intellectual property rights. They are the total property of Sergio Capone SRL or its partners. Any kind of reproduction or representation, subject to counterfeiting may result in the occurrence of civil and criminal liability of its author. Links pointing back to the Site www.sergiocapone.com and using the techniques of “framing” or “in-line linking” are formally prohibited. In any case, any link or other content mentioned above, even if tacitly authorized, must be withdrawn immediately and at the simple request of the company Sergio Capone SRL, under penalty of the consequences of the law.
